Alians-DN OOD is among the top manufacturers of jar caps in Bulgaria, with export activity on the European market. The company is experiencing severe damages due to the imitation of its trademarks and industrial designs by competitors. Kambourov & Partners has been retained as counsel and has been providing ongoing assistance on the development of a multilevel strategy to prevent the ongoing IP rights infringement and to obtain compensation on a national and EU level before the competent administrative bodies and courts.
Kambourov & Partners achieved a final judgement of the Supreme Administrative Court (SAC), which cancels an industrial design of the client’s biggest competitor. Furthermore, our IP team recently obtained another favourable decision of the SAC, confirming a previous judgement of the same, rendered in a very complex case against a decision of the Commission for Protection of Competition. The SAC recognized the existence of strong similarity between Alians-DN’s product and the product manufactured by one of its competitors. The court issued a decision ordering the termination of the distribution of the imitating product, as well as the imposition of a fine. This decision is final and not subject to appeal.
