New win for the IP team of Kambourov & Partners Attorneys at Law as they successfully represented Sofia Municipality in a copyright litigation.The dispute was initiated by Prof. Starchev - sculptor of elements from the “1300 years Bulgaria” monument, which used to be located in front of the National Palace of Culture in the centre of Bulgaria’s capital.
With a decision dated 26 November 2018, the Sofia City Court, as the court of first instance, dismissed all of Prof. Starchev's claims and concluded that the actions of Sofia Municipality with regard to the “1300 years Bulgaria” monument have been carried out in line with the legal requirements. Already a complex and multi-faceted case due to the combination of copyright, administrative and property law issues, the matter was further complicated by the existence of IP rights acquired under the regime of the old Bulgarian copyright law and their enforcement that is subject to the current Copyright and Neighbouring Rights Act.
