The firm's competence in the area is well-grounded in the consultancy and representation of clients in public procurement and concession procedures, PPPs and other projects in various sectors of the Bulgarian economy. The department assists through the drafting of required tender documents and paperwork; consults on the preparation of the relevant bids, provides legal support in the course of the negotiations with the competent government and municipal authorities. Clients are represented before the Commission for Protection of Competition and the Supreme Administrative Court in appeals against awarding of public procurement and concession contracts.
The team has the depth and diversity of experience to assists companies, state & municipal bodies and investors through the development and realization of large-scale infrastructure and PPP projects including procurement, legal due diligence, acquisitions and dispositions, planning and development, construction, transaction structuring, negotiations, finance, securitization, joint venturing, investments, taxation, operations. The department has across-the-board experience and is active in a range of sectors including airports, ports, rail, road, infrastructure in the context of commercial buildings development and construction, social infrastructure, water, waste.
Specific focus is dedicated to the defence and security sector, where the firm has been involved in significant projects of national importance and has the capabilities to advise on thespecific requirements to the security and defence tenders under the Bulgarian Public Procurement Act, on the requirements of defence-related products and dual-use items, on the Technologies Export Control Act, on the transportation requirements through the territory of the Republic of Bulgaria of defence-related products, on the specific requirements concerning the design and construction of new production facility, as well as on security clearance and access to classified information.
Another accent in Kambourov & Partners’ public sector expertise are privatization procedures. Privatization of state-owned companies in the late 90s acted as a major push in the firm’s development, whereas it was retained to represent either the Bulgarian state or prospective buyers of key state enterprises in virtually all sectors of the Bulgarian economy, most eloquent examples being the privatizations of the Bulgarian Telecommunications Company, Bulgartabac Holding, National Movie Center, electricity distribution companies, National Cargo Railway Operator, Municipal Bank, etc..
