The custom-built KP IPR software, MAGIYA, was created through close collaboration between software developers and the firm's experts in trademark and AI law.

The software efficiently monitors trademarks in the firm's portfolio against newly filed applications. The team has ensured that the tool provides optimal protection for clients by combining legal expertise with an advanced technical algorithm.

Trademarks have always been a crucial component of Kambourov & Partners' IP practice. With decades of experience in trademark law and the continuous management of hundreds of trademarks, the team invested significant time and effort into developing this tailor-made solution to protect its clients' trademark rights.

As many trademark holders know, registering your trademark is not enough to guarantee its protection. Under current legislation, there is no ex officio examination of new trademark applications for conflicts with earlier rights. Trademark holders must monitor new applications themselves and oppose them in case of conflict. This requires reviewing the daily EUIPO bulletin and the biweekly BPO bulletin where new trademark applications are published.

Failing to identify a conflicting new application in time can result in the loss of market position, a weakening of a trademark's distinctive character, or even the termination of earlier rights.

Currently, there are two primary approaches to addressing this issue: lawyers can manually review newly published trademark applications, or the task can be outsourced to an external service provider, typically charging an annual fee per monitored trademark. However, neither option is ideal for clients with large portfolios or limited IP budgets.
